GOL-BALL GLOBAL S.L. (“we” or “us” or “GOL-BALL”) is a company that enables users (“you” or “user”) to purchase collectibles of the goalscoring balls of their favourite football teams and players. GOL-BALL converts each goalscoring ball into digital collectibles backed by blockchain technology, so that each user can purchase through the platform a certified collectible of the goal balls of their favourite football teams and players.

We respect your privacy and are committed to providing a secure environment for our Users. This privacy policy (“Policy”) is intended to provide you with important information about how and why GOL-BALL may collect and process your data. All personal data collected will be processed in accordance with applicable law, including European Union laws governing the protection of personal data. This Policy forms part of the Terms and Conditions.

1. Purpose of data collection

We collect and process personal data for specific purposes, such as enabling you to access the services offered, making the services easy to use, improving your experience, ensuring security, reliability and preventing fraud. Whenever we collect your personal data, we undertake to always collect the minimum amount of Data that is necessary for the relevant purpose.

This section provides more information about what personal data we collect, what we process that data for and the legal basis for each specific processing purpose.

Account Information: GOL-BALL collects and processes data to allow you to create and access your User account. In order to manage your User account from creation to deletion, you must provide us with some information about yourself (i.e. your first name, last name, username, email address and for some operations your phone number for identity verification purposes). You will also be able to store your personal settings, preferences and favorite teams or players on your general User account.

The legal basis of this data processing is contractual. We require this in order to create and maintain your User account, execute the Terms and Conditions, and any other applicable Additional Terms that you agreed to when registered for your User account.

Use of the Website and Mobile APP: GOL-BALL collects and processes some data to understand how Users interact with the Services and to improve the User experience. This Data consists of various browsing information derived from Cookies or mobile technical identifiers, some of which may include Personal Data.

The legal basis for this processing is contractual. The use of cookies is conditional upon the prior consent of the Users, this taking into account that such consent is given by an affirmative act reflecting the Users’ free, specific, informed and unambiguous declaration of will to accept the processing of their data.

For users residing in the European Union, the acceptance of the processing of their personal data and the use of cookies will be carried out in accordance with the European Data Protection Regulation 2016/679.

Access to and Use of the Services: GOL-BALL collects and processes Personal Data to allow you to access and use the Services, including facilitating the purchase of a collectibles. To purchase and/or exchange a collectible, GOL-BALL collects your username, phone number, and email.

The legal basis of this processing is contractual. We require this data in order to execute the Terms and Conditions.

Account Security: GOL-BALL collects device and browser information, browsing data, including IP address (from which information of your location can be inferred), account information (including your email address and phone number) and transaction details, to ensure the security of the Services and your User account, and to detect, prevent, investigate, and/or trace any attempt to violate our Terms and Conditions. During an investigation, GOL-BALL may take additional security measures, including but not limited to requesting additional supporting documents and/or information, or suspending or canceling the relevant transaction in the event the transaction cannot be verified. When payment fraud has been investigated and confirmed, the relevant Data and other related information will be stored in GOL-BALL’s system, so that if necessary it can be handed over to the competent authorities within the parameters of the law, for the purpose of reporting the commission of crime and fraud.

The legal basis of this processing is the legitimate interest of GOL-BALL. This legitimate interest is to detect, prevent and investigate fraud and to protect its Services and Users against possible financial fraud, malicious distribution of data or damage to computer systems.

2. Data Storage

Account Information: GOL-BALL will keep your Personal Data until your account is closed.

Use of the Website and Mobile APP: GOL-BALL will not retain Personal Data processed for analytical or other research or analysis purposes once such research has been completed and the relevant reports, results and/or insights have been produced.

Access to the Services: Personal Data processed for the use of the Services will be retained as long as the user account is active.

Account Security: Personal Data processed for fraud prevention purposes will be retained for three (3) years after the relevant data has been included in an alert list. Personal Data processed for security purposes will be retained for five (5) years from the last login to the account or suspicious activity.

Notwithstanding the above, GOL-BALL may store some Personal Data for a longer duration pursuant to its legitimate interests and applicable legal obligations.

In the event that in the course of processing the Personal Data provided is destroyed, lost or accidentally disseminated without prior authorisation by the User, the injured party shall have the right to receive full and effective compensation for the damages suffered. If the person responsible for the loss of said personal data is an agent external to GOL-BALL, the Company shall be considered exonerated from any type of commitment to the user.

3. Processors

GOL-BALL may use Third-Party Service providers and other third parties (“Processors”) to facilitate, maintain, improve, analyze, and protect the Website, App, and Services. Processors may have access to Personal Data for the sole and exclusive purpose of carrying out the processing activity assigned by GOL-BALL to the relevant Processor.

4. Data Sharing

GOL-BALL may share your Personal Data with Third-Party Service providers and suppliers which assist GOL-BALL for fulfilling the purposes specified in this Policy. Preserving the confidentiality of the information transferred and safeguarding the rights that each user has over the private information provided.

Some content or features of the website and/or application are provided by third party service providers. To facilitate your access to such content and/or features, GOL-BALL may share some of your personal information with such providers and third parties. In the services provided may request additional data from you, whether or not integrated into the Website and/or App directly, these third party services collect and process the data they receive in accordance with their relevant privacy policy, under the sole responsibility of that provider, exonerating GOL-BALL from liability for the data handling and privacy policies implemented by such external agents.

5. Use of Children’s Data

The Website, App and Services are not directed to children under the age of 18 and we do not knowingly collect Personal Information from users who have not reached the age of majority. If we find that we have collected Personal Information from a child under the age of 18, we will take reasonable steps to delete such information from our files as soon as possible, unless we are legally required to retain it.

You may access, correct, amend, or delete certain Personal Information you may have provided us through account.
